A direct tax imposed on the income of individuals who earn money within the jurisdiction of the People’s Republic of China. This individual income tax applies to both domestic citizens and foreign residents, though the calculation of the tax depends on the duration of their stay and the source of their income. It governs the taxation of wages, salaries, bonuses and other forms of compensation such as investment income or property rental.
The tax is the primary mechanism for the state to collect revenue from the labor force and to reduce income inequality through a progressive rate structure. It stops applying when an individual’s total income falls below the standard deduction threshold or when they qualify for specific exemptions under a double tax treaty. For a foreign professional working in China, this tax is a major component of their total employment cost and their net take home pay.

Residency Determination
Status of a taxpayer as a resident or a non resident determines the extent of their liability for the individual income tax. A person is considered a resident for tax purposes if they maintain a domicile in China or if they reside in the country for a cumulative period of one hundred and eighty three days in a calendar year. Residents are generally taxed on their worldwide income, while non residents are only taxed on the income they earn from sources within the mainland.
This distinction prevents the double taxation of global earnings for short term visitors while ensuring that long term residents contribute to the local public purse. The system uses a six year rule that allows foreigners to avoid paying tax on their overseas income if they leave the country for a period of more than thirty days at least once every six years. This mechanism encourages international experts to remain in the country for extended periods without facing an excessive tax burden on their home country investments.
Progressive Calculation
Taxable income is calculated by subtracting a standard monthly deduction and specific social insurance contributions from the gross monthly salary. The individual income tax uses a multi stage progressive rate table that ranges from three percent to forty five percent. Higher earners pay a larger percentage of their income in tax, which is intended to redistribute wealth and fund social services.
In addition to the standard deductions, taxpayers can claim special additional deductions for expenses such as children’s education, medical treatment for serious illnesses and interest on housing loans. These deductions are designed to lower the tax burden on families and to support the overall goal of social stability. The accuracy of these claims must be verified by the employer or the individual through a digital platform provided by the state taxation administration.

Employer Obligation
Companies operating in China have a statutory duty to act as withholding agents for the individual income tax of their employees. This means the employer must calculate the correct amount of tax each month and deduct it from the employee’s pay before transferring the funds to the tax bureau. The firm is also responsible for filing monthly reports and for ensuring that the personal information of the staff is up to date in the government system.
If an employer fails to withhold the tax or files an inaccurate report, they are liable for the missing amount and for any associated penalties. This administrative structure ensures a high level of compliance by placing the responsibility on the entity with the most direct access to the payment data. The final step for many taxpayers is the annual reconciliation filing, where they calculate their total liability for the year and claim any additional refunds.
This yearly check ensures that the total tax paid matches the actual income and deductions of the individual, providing a complete record of their fiscal status.
