Meaning
Administrative determinations executed by customs authorities fix the legal tariff classification, customs value, and applicable duty rates for incoming foreign merchandise. Customs officers conduct import tariff assessment procedures under the Customs Law of the People’s Republic of China to calculate import customs duties and value-added taxes payable upon entry. Declarations undergo automated risk analysis and physical inspection to verify declared prices against statutory valuation standards.
Official assessment clearance is mandatory before imported cargo is released from port supervision into domestic commerce.
Valuation Methodology
Customs evaluators establish dutiable value based primarily on the transaction value of imported merchandise, including freight and insurance charges incurred prior to unloading. When transaction prices are rejected due to related-party influences or incomplete documentation, evaluators apply statutory hierarchy valuation methods. Sequential valuation rules consider transaction values of identical goods, similar goods, deductive values, or computed values based on production costs.
Duty Determination
Customs duty rates apply based on country of origin rules and prevailing national tariff schedules. Statutory tariff categories include most-favored-nation rates, agreement rates, preferential rates, and general tariff rates. Anti-dumping duties or countervailing duties attach directly to specified merchandise originating from designated exporting countries.
Administrative Dispute
Importers disputing duty determinations must pay the assessed duties prior to filing formal administrative reconsideration applications. Disagreements regarding tariff classification or transaction valuation must be submitted to higher customs authorities within sixty days of payment receipt issuance. If administrative reconsideration fails to resolve the valuation dispute, importers may file administrative lawsuits in local courts.
The import tariff assessment process establishes binding financial obligations that must be satisfied before goods achieve customs clearance.
