Legal Standing
Under Chinese customs law, only a locally registered business entity can act in this capacity. The import agent of record must possess a valid business license and a customs registration certificate. Foreign companies cannot perform this role directly.
Therefore, they must contract with a licensed Chinese trading company or logistics provider to handle the official import formalities on their behalf.
Liability Apportionment
Delegation of customs duties does not absolve the primary declarant of their official obligations to the government. Although the import agent of record handles the administrative filing, they share a complex legal relationship with the actual buyer. In the event of an incorrect declaration, the customs authority holds the import agent of record primarily liable for any underpaid duties or administrative fines.
This creates significant risk for the agent. To manage this exposure, agents require foreign principals to sign detailed indemnity agreements and deposit duty payments before clearance begins.
Compliance Standard
Importers must expect their agents to exercise a high degree of diligence when verifying the shipping documents provided by the foreign exporter. Since the import agent of record faces direct penalties for classification or valuation errors, they must review the commercial invoice, packing list, and technical sheets before filing the customs declaration. The agent has the right to refuse to file a declaration if the documentation is incomplete or suspicious.
This scrutiny protects the agent from being drawn into customs disputes. It also helps maintain their corporate compliance rating, which directly affects their clearance times for future shipments.
