The housing provident fund management regulations provide the legal foundation for these mandatory contributions, setting the rules for register creation and account funding. This policy is administered by municipal housing fund centers under the guidance of the Ministry of Housing and Urban-Rural Development.
It applies to all domestic enterprises and foreign-invested companies.
Employer Obligation
Every business operating in China must establish a registration account with the municipal fund center within thirty days of incorporation. According to the housing provident fund management regulations, companies must calculate and withhold the employee contribution from the monthly salary while making an equal matching contribution. The statutory contribution rates range from five to twelve percent of the average monthly wage of the employee.
Employers must deposit these funds on a monthly basis, and failure to do so can result in legal liabilities.
Enforcement Tool
Housing fund centers hold statutory authority to enforce payment compliance through administrative audits and court orders. Under the housing provident fund management regulations, if an employer fails to register or underpays the required contributions, the center can order rectification within a specified time limit. If the company fails to comply with the rectification order, the center has the power to apply to a people’s court for compulsory enforcement.
This judicial pathway allows the state to freeze corporate accounts and seize assets to settle the outstanding fund deficits, while also imposing administrative fines on the non-compliant enterprise. Such enforcement ensures that corporate entities do not treat housing contributions as optional benefits during times of economic transition.
Employee Entitlement
Staff members can withdraw these accumulated balances only under specific conditions defined by the state. The housing provident fund management regulations allow workers to use the funds to purchase a house, construct a home, pay rent, or cover major home renovations. Upon retirement, the employee can withdraw the entire remaining balance in their personal account as a lump sum.
This mechanism protects the welfare of the workforce by ensuring that these savings are used exclusively for housing security.
