This mechanism represents the legal channel through which an overseas creditor can access assets located in China to satisfy an unpaid debt or damages award. Through foreign judgment registration, the domestic court reviews the external decision under the principles of international treaties or reciprocal relationships.
The procedure does not re-examine the substantive merits of the dispute, but focuses strictly on procedural fairness and sovereignty compliance.
Jurisdictional Requirement
The legal basis for this process demands the existence of a bilateral treaty on judicial assistance or a demonstrated reciprocal relationship between China and the foreign jurisdiction. Chinese courts evaluate whether the originating foreign court possessed valid jurisdiction over the defendant according to domestic legal standards. For foreign judgment registration to proceed, the applicant must show that the defendant received proper and timely service of process in the original foreign action.
This requirement prevents the registration of default judgments where the defendant had no opportunity to present a defense.
Procedural Stage
The enforcement action commences when the judgment creditor files a formal petition with the Intermediate People’s Court located at the domicile of the debtor or where the debtor’s assets are located. The petition must include legalized copies of the judgment and proof of its finality, translated into Chinese by a certified agency. Under the framework of foreign judgment registration, the court establishes a review panel to examine the documentation for potential conflicts with national public policy or sovereignty.
If the court determines that the judgment was obtained through fraud or that it violates the fundamental principles of Chinese law, the application is rejected. The court issues a civil ruling that either grants or denies the enforcement request after completing this scrutiny.
Enforcement Outcome
The approval of the petition converts the foreign decision into a domestic ruling that is fully executable by court-appointed enforcement officers. Creditors can then initiate the freezing, seizure, and auction of the debtor’s onshore bank accounts, real estate, and corporate equity.
