Statutory court proceedings conducted under international treaties and national civil procedure allow Chinese intermediate people’s courts to grant legal validity to international arbitration rulings rendered outside mainland China. Pursuant to the 1958 New York Convention and Article 300 of the PRC Civil Procedure Law, foreign arbitral award recognition represents the compulsory legal portal through which a foreign award creditor converts an offshore arbitral decision into an enforceable domestic title. Foreign buyers winning arbitration cases in Singapore or London against mainland suppliers must petition the intermediate court where the respondent resides or holds assets.
Upon court confirmation, the arbitral ruling acquires the identical legal standing and enforceability as an effective civil judgment issued by a domestic Chinese court.
Judicial Review
Reporting mechanisms established by the Supreme People’s Court mandate centralized supervision before any lower court can refuse enforcement. Intermediate courts seeking to deny recognition to an award must submit their proposed refusal through provincial high courts to the Supreme People’s Court for final confirmation. This prior reporting system minimizes regional judicial protectionism and ensures uniform application of New York Convention standards across all Chinese administrative divisions.
Applicants must supply authenticated original awards and certified Chinese translations when filing their petition.
Public Policy
Refusal grounds mirror Article V of the New York Convention, including invalid arbitration agreements, lack of proper notice, procedural irregularities or decisions exceeding submission scope. Courts also invoke the public policy exception, though Chinese judiciary interprets this narrow exception strictly to cases threatening social stability or state sovereignty. Disagreements over interpretation of substantive contract terms do not constitute public policy violations.
Execution Mechanism
An order approving recognition enables immediate transfer of the case file to the court’s enforcement bureau for asset seizure. The petitioner then exercises full creditor remedies including account freezing and property auctions. Recognition proceedings stall if the respondent initiates set-aside actions at the seat of arbitration.
