Meaning
Physical tax threshold is defined as a fixed location through which the business of an enterprise is wholly or partly carried on. A fixed place permanent establishment includes branches, offices, factories, workshops or places of extraction of natural resources.
Physical Nexus
Existence of a specific geographic location that is used for business activities for a certain duration triggers this classification. A fixed place permanent establishment requires more than a temporary or incidental presence in a location. The Chinese tax authorities evaluate the permanence and the business nature of the site to determine if it constitutes a taxable nexus.
Exemption Boundary
Preparatory or auxiliary activities such as storage, display or delivery of goods do not usually create this specific tax status. If the location only performs tasks that do not form part of the core profit-making activity, a fixed place permanent establishment might not be recognized. This distinction is found in most double taxation avoidance agreements signed by the People’s Republic of China.
Audit Risk
Companies operating without a registered branch office may face scrutiny if their physical footprint suggests a taxable presence. Detection of a fixed place permanent establishment by the tax bureau leads to retroactive tax assessments and potential fines for failing to register a business place. Documentation of the activities conducted at every site is necessary to defend against incorrect classifications.
This liability extends to all income attributable to the fixed location.
