Meaning
A set of legal measures and strategies used to lift or alter travel restrictions imposed on foreign nationals during civil or commercial disputes in China prevents prolonged detention. Under exit ban mitigation, the affected party can petition the court or relevant authority to lift the travel restriction by offering alternative security or showing that the measure is unwarranted. This process balances the enforcement of judicial claims against the freedom of movement of foreign personnel.
Administrative Request
The foreign national must submit a formal application to the court that issued the restriction order. This application must demonstrate that the applicant is not a direct debtor or that the dispute has been resolved through other means. In many cases, clarifying the applicant’s role within the company is sufficient to lift the ban.
Security Deposit
Providing financial guarantees is the most effective method to secure the release of travel restrictions. The debtor or a third party can deposit sufficient cash with the court or provide a bank guarantee that covers the total value of the disputed claim. This deposit ensures that the creditor’s rights are protected while the foreigner travels.
It allows the affected individual to return to their home country to organize the corporate assets needed to resolve the dispute.
Judicial Resolution
The court reviews the application and the provided security to decide whether to lift the restriction. If approved, the court notifies the exit and entry administration to remove the individual from the border control list. This step can take several days to process through administrative channels.
