Judicial Execution
Creditors must obtain a final, executable court judgment before they can initiate the formal process of seizing and selling a debtor’s immovable property. An enforced real estate liquidation begins with the court issuing a seizure order, which is registered with the local natural resources bureau to block any voluntary transfer of the asset. This judicial block prevents the debtor from devaluing the asset or transferring title to a related entity while the liquidation is pending.
Auction Process
Sellers and court officials utilize approved online platforms to conduct public bidding in a transparent and competitive environment. During an enforced real estate liquidation, the property is typically listed on a designated court auction website at an initial price determined by professional appraisers. If the first round fails to attract bidders, the court will reduce the starting price for a second round, or eventually allow the creditor to accept the property itself as payment in kind.
Creditor Priority
Distribution of the proceeds generated from judicial sales is strictly governed by statutory preference rules rather than the order of filing. Prior to executing an enforced real estate liquidation, the court must resolve competing claims from mortgagees, construction workers with unpaid wages, and tax authorities. Mortgage holders generally enjoy priority over ordinary business creditors, meaning that unsecured foreign trade partners may receive little to no recovery if the property’s value is fully consumed by senior liens.
