Meaning
Intellectual property prosecution strategy involving the simultaneous submission of a utility model and an invention patent for the same technology provides immediate and long-term protection in China. The practice of dual patent filing allows a manufacturer to exploit the rapid grant of the utility model while the invention patent undergoes substantive examination. This method is used to secure early market protection against local competitors in high-turnover consumer goods.
Operational Advantage
Companies receive the utility model grant within several months because utility models do not undergo a substantive examination for novelty and inventiveness. This rapid registration enables the manufacturing facility to enforce its rights against infringers through local intellectual property bureaus almost immediately. The long-term advantage is realized later when the invention patent is granted, offering stronger protection that survives invalidation attempts.
Statutory Requirement
Under the rules of the China National Intellectual Property Administration, both applications must be filed on the exact same day. The applicant must explicitly declare the existence of the dual filing in both applications at the time of submission. If the applicant fails to disclose the other application, the second filing will be rejected under the double patenting prohibition.
Enterprise Strategy
Manufacturing enterprises must manage their patent portfolio carefully to transition from the utility model to the invention patent. When the invention application is deemed patentable, the applicant must formally abandon the utility model to allow the invention patent to be granted. This transition requires a coordinated administrative filing that must be executed within the time limits set by the patent office to avoid losing both rights.
If the abandonment is not filed on time, the invention application will be rejected, and the applicant will be left with only the shorter-term utility model protection.
