Meaning
A binding decision rendered by an arbitration commission within the territory of the People’s Republic of China resolves civil and commercial disputes between contracting parties. Under the PRC Arbitration Law, domestic arbitral awards are those rendered by Chinese arbitration institutions without any foreign-related elements in the dispute. This classification is distinct from foreign-related and foreign awards, which face different legal standards for judicial review.
The finality of these decisions means they cannot be appealed on the merits, establishing an immediate obligation for the losing party to comply with the terms, and the civil division of the local court system maintains jurisdiction to oversee their execution.
Enforcement Procedure
An application for execution must be submitted to the intermediate people’s court where the respondent is domiciled or where the property is located. For domestic arbitral awards, the execution process follows the Civil Procedure Law of the PRC. The court has the authority to freeze assets and seize bank accounts to ensure compliance.
Judicial Refusal
A court may refuse to enforce the decision or set it aside if the party proves specific procedural defects. For domestic arbitral awards, these defects include the absence of an arbitration agreement, or the dispute falling outside the scope of the tribunal’s authority. Alternatively, courts may intervene if the composition of the tribunal violated legal procedures.
Unlike foreign-related awards, the court can also review these decisions for insufficiency of key evidence or falsification of evidence.
Foreign Interest
A foreign investor operating through a local subsidiary must understand that disputes with domestic suppliers fall under this local jurisdiction. When domestic arbitral awards are issued against local joint venture partners, the foreign parent company must rely on the local court for enforcement. The lack of foreign-related factors means the regional courts exercise broader scrutiny over both the procedural and substantive aspects of the case.
