The baseline calculation stops applying when goods enter bonded warehouses or qualify for statutory duty exemptions under accredited processing trade arrangements.
Valuation Structure
Transaction value forms the primary baseline, comprising the price paid or payable by the buyer to the seller for goods destined for domestic import. To establish the correct customs taxable value, officials adjust the invoice price by adding unincluded buyer-paid costs such as commissions, container packaging, assist materials, royalties, and international freight to the arrival port. Exclusions apply to post-importation construction fees, internal transit costs, and financial interest charges when separately itemized in commercial contracts.
Failure to substantiate statutory deductions results in their inclusion within the assessable total.
Substitute Calculation
Authorities resort to statutory substitute methods when declared transaction values lack arm’s-length independence or sufficient documentation. Officials apply identical goods value, similar goods value, deductive value, computed value, or reasonable estimation rules in strict sequential hierarchy. Special customs panels evaluate related-party transfer pricing models against domestic market benchmarks.
Importers must supply detailed cost accounting records when computed value methodologies apply.
Administrative Challenge
Taxpayers disputing valuation adjustments must settle assessed tax notes before lodging formal administrative review applications. Proceedings follow statutory administrative reconsideration rules.
