Administrative Approval
Official permission must be obtained from the Cyberspace Administration of China for any data transfer that exceeds regulatory limits. For cross border data flows that involve large-scale personal information or any important data, the exporting entity must pass a formal security assessment. This is an administrative approval process, and the regulator evaluates the risk of foreign government surveillance and the destination country’s data protection level.
If approval is denied, the data cannot leave China under any circumstances.
Operational Risk
Multinational companies must design their IT architectures to isolate local operations from global networks. Under these rules, unrestricted cross border data flows are blocked, which prevents foreign parents from accessing the raw transaction databases of their Chinese subsidiaries. This creates substantial friction for HR databases and global supply chain software.
Foreign businesses must deploy local servers and process data locally to avoid disruptions.
Compliance Duty
Regular self-monitoring and documentation are required of all businesses operating in China to prove they conform to data export rules. To maintain cross border data flows, an enterprise must conduct a personal information protection impact assessment before transferring any personal data overseas. The resulting report must be kept for three years, and the transfer contract must be filed with the local Cyberspace Administration office.
This filing is a statutory duty that must be fulfilled before the transfers begin, and failure to do so allows the regulator to order the immediate cessation of the data flow and impose substantial fines.
