Meaning
Employment authorization for foreign nationals appointed to lead a representative office in China is a mandatory requirement for legal residency and operation. The chief representative work permit is issued by the State Administration of Foreign Expert Affairs and links the individual to the specific registration of the foreign entity. Without this document, the chief representative cannot apply for a Z-class residence permit or manage the office’s official bank accounts.
Authorization Requirement
Applicants must provide proof of their professional qualifications and a clean criminal record from their home country to obtain the permit. The chief representative work permit is granted based on the parent company’s status and the legitimate registration of the representative office. Authorities may request a legalized appointment letter to confirm the individual has the power to sign documents on behalf of the foreign headquarters.
Quota Restriction
Local regulations often limit each representative office to a small number of foreign representatives, with the chief representative holding the primary slot. The chief representative work permit is part of this quota system and cannot be easily transferred to another person without a full cancellation and re-application process. If the office exceeds its allowed headcount of foreign staff, the application for additional permits will be rejected by the labor bureau.
This restriction ensures that representative offices remain focused on liaison and market research rather than large-scale operations.
Renewal Duty
Permits are typically valid for one year and must be renewed at least thirty days before the expiry date. The renewal of the chief representative work permit requires the office to demonstrate it has complied with tax filings and annual reporting requirements. Failure to renew the permit on time results in the immediate loss of legal working status and may lead to fines for both the individual and the parent organization.
