This administrative policy simplifies treasury management by removing the requirement to submit transaction-by-transaction evidence of use prior to currency conversion.
Conversion Option
Foreign-invested companies initiate the conversion by submitting a request to their domestic account bank. The process under capital account discretionary settlement permits the company to convert up to one hundred percent of its registered capital according to market exchange rates. These funds can then reside in the special renminbi settlement account until the company executes its planned business payments.
Statutory Restriction
Regulatory limits prevent converted funds from being used for expenditures outside the registered business scope of the enterprise. For example, capital account discretionary settlement does not authorize the purchase of domestic real estate not for self-use, nor does it allow investments in high-risk financial derivatives. Furthermore, converted capital cannot be used to extend loans to unrelated parties unless the business license specifically allows such financial services.
Violations of these restrictions lead to immediate account suspension and regulatory investigation by the foreign exchange bureau, which can impose substantial administrative fines.

The foreign exchange authority uses a specialized administrative platform to track the movement of funds from the pending payment accounts. Post-conversion audits determine if the enterprise used the funds in accordance with industrial policies and tax regulations.
