Meaning
Digital records verified through distributed ledger technology provide a verifiable chain of custody for commercial transactions and intellectual property filings within the Chinese judicial system. This category of blockchain evidence originates from the Electronic Signature Law and is formalized through technical standards issued by the Supreme People’s Court to ensure data integrity. It stops applying when the underlying hash value does not match the original file or when the node network lacks the neutrality required by regional court regulations.
Within the Chinese litigation landscape, this data functions as a tool to bridge the gap between private records and court-accepted truth.
Technological Verification
Cryptographic hashing creates a unique digital fingerprint for any document or record generated during a commercial transaction. Once the hash of a contract is uploaded to a ledger, the blockchain evidence ensures that any subsequent modification to the original file becomes detectable. This mechanism relies on the mathematical impossibility of reversing the hash or finding a collision where two different files produce the same output.
Verification requires the presenting party to provide the original electronic file alongside the block address and the proof of work or stake used by the network. Such a process eliminates the need for third-party notarization when the chain itself is recognized by the judicial authority. The system operates by comparing the hash of the file provided in court with the hash stored at the specific block height.
If the two strings match, the court accepts that the file has remained unchanged since the timestamp. This provides a level of certainty that traditional email archives cannot match.
Judicial Integration
The Supreme People’s Court of China has issued specific judicial interpretations that grant legal validity to data stored on distributed ledgers. This legal status allows blockchain evidence to be admitted without the traditional hurdles of authenticating digital screenshots or unencrypted emails. Most Internet Courts in China, specifically those in Hangzhou and Beijing, have built dedicated platforms that integrate directly with major industry ledgers.
These platforms allow a judge to verify the authenticity of a claim by clicking a link that triggers an automated check against the ledger. It reduces the time required for pre-trial evidence exchange. The court evaluates the credibility of the platform based on its degree of decentralization and the presence of neutral nodes operated by government or judicial entities.
When a platform is owned by one of the litigants, the court usually requires additional proof of neutral operation. This often takes the form of a report from a state-certified forensic center.
Evidentiary Admissibility
The power of a digital ledger entry depends heavily on the timing of the hash upload relative to the creation of the underlying document. Effective blockchain evidence must be recorded at the moment of the transaction to prevent allegations of tampering during the delay period. If a party uploads a file weeks after a dispute begins, the court often views the record with skepticism.
The burden of proof remains with the party challenging the record once the initial hash matches the file in court. Successful litigation often hinges on showing that the blockchain platform adheres to the National Standard for Blockchain and Distributed Ledger Technology. This compliance ensures the record survives scrutiny regarding the security of the consensus mechanism used by the network.
Even when a record is technically sound, it may fail if the private keys used for the signature were not held under the exclusive control of the signatory. The court maintains the right to dismiss any record that shows signs of centralized manipulation by one of the litigants. This oversight ensures that the technology does not bypass the fundamental requirement for fair and transparent litigation.
The strength of the record is tied to the transparency of the hashing sequence and the independence of the nodes that validated the transaction at the time of entry.
