Meaning
Asset preservation by judicial or administrative command restricts a bank from allowing withdrawals or transfers from a specified deposit account to protect the interests of a claimant. A beneficiary account freeze prevents the movement of disputed funds during civil disputes or regulatory investigations in China. The measure remains in force until the frozen amount is released by court order or the statutory duration of the freeze expires.
Administrative Order
Chinese courts or public security bureaus issue the freezing instruction directly to the depository bank through an integrated online registry. The bank must execute the block immediately without prior notice to the account holder.
Operational Constraint
The frozen status applies to the specific bank account and blocks outgoing transactions up to the amount specified in the judicial order. Normal business operations of the company are restricted because payment of wages and supplier invoices becomes impossible.
Remedial Option
Account holders can apply for a release of the freeze by providing equivalent alternative security such as a cash deposit or a bank guarantee to the court. Once the court accepts the alternative collateral, it must issue a release order within five days. This mechanism permits the business to resume normal cash flow during litigation.
