Meaning
Financial control measures implemented by judicial or administrative bodies prevent the debiting and transfer of funds held in commercial bank accounts. When bank account freezing occurs during a Chinese civil dispute, the court instructs the operating bank to lock the specified funds up to the claim value. This restriction ensures that the claimant has access to liquid assets if they win the lawsuit.
The account can still receive incoming deposits, but outgoing transactions are blocked unless authorized by the court.
Regulatory Compliance
Banking institutions execute judicial orders to freeze funds under the authority of the People’s Bank of China. Upon receiving a formal notice of assistance, the bank must restrict the account immediately.
Litigation Impact
Disruption of daily operations is the primary consequence for a business entity facing this measure. A frozen account prevents the payment of supplier invoices, employee salaries, and tax liabilities, which can quickly destabilize a company. This operational paralysis often forces the respondent to negotiate a settlement or provide alternative security to resolve the freeze.
Cash flow ceases to function normally, creating immediate pressure on corporate leadership to address the underlying dispute.
Release Protocol
Unfreezing the funds requires a specific judicial order issued by the same People’s Court that initiated the restriction. This procedure begins when the respondent submits a formal request supported by evidence of alternative collateral, or when the dispute is resolved. If the court accepts the alternative security, it must issue an unfreezing notice to the bank within a prescribed timeframe.
The bank then restores normal transaction privileges to the account holder.
