Meaning
Restitution of assets received without legal grounds prevents a party from retaining financial benefits that lack a contractual or statutory basis. Under article 985 civil code, any party that obtains a benefit to the detriment of another without legal cause must return that benefit to the injured party. This rule ceases to apply if the transfer is deemed a voluntary donation or a performance of a moral obligation.
Return Obligation
The recipient must return both the original asset and any derived yields, such as interest or rental income, to the rightful owner. If the original property has been consumed or destroyed, the recipient must provide equivalent financial compensation.
Statutory Exclusion
Exemptions from the duty to return apply when the payment was made to discharge a debt before its maturity date or when the payer knew there was no obligation to pay. These exceptions protect recipients who acted in good faith during commercial transactions.
Enforcement Action
Claimants must initiate civil litigation in the local Chinese court to recover the enrichment if the recipient refuses voluntary restitution. The court orders the freezing of the disputed funds or assets during the litigation. This formal remedy guarantees that recovery can be executed after the final judgment.
