This period allows interested third parties, such as foreign victims or joint venture partners, to assert their legitimate claims over the seized assets before any final confiscation order is issued.

Confiscation orders issued under this statutory mechanism provide the legal basis for international judicial assistance and cross-border recovery of corrupt gains. Chinese authorities present these formal orders to offshore jurisdictions, such as Hong Kong or Singapore, to execute asset freezing and repatriation under bilateral treaties. Without such a domestic judicial determination, foreign courts rarely cooperate with repatriation requests.
Procedural Protection
Domestic legislation balances public interest with the protection of private property rights by allowing defendants to appoint legal counsel to represent them during the confiscation hearings. If the defendant or their close relatives disagree with the court’s confiscation ruling, they can file an appeal with the higher court within five days of receiving the decision.
