An administrative challenge under the PRC Civil Procedure Law allows a non-party asserting ownership or a distinct civil interest to object to the execution of court-ordered enforcement against specific assets. An Article 227 objection stops the execution process temporarily while the court evaluates the claimant’s underlying property right. The objection applies strictly to the enforcement phase of civil litigation.
Procedural Mechanism
Filing this petition requires the third party to submit written evidence of their legitimate ownership or right of occupancy to the executing court within fifteen days of learning about the execution measure. If the court finds the claim valid, the judge terminates enforcement against that property. If it is rejected, the objector may file a follow-up lawsuit within fifteen days to contest the execution.
This statutory pathway protects genuine asset owners from the collateral effects of a debtor’s default.
Legal Consequence
Rejection of the petition permits the court to resume the public auction or sale of the disputed asset. A successful protest, however, shifts the burden of proof to the execution applicant who must now litigate the ownership question in a separate trial. This trial suspends the distribution of proceeds from that specific asset.
Risk Boundary
Operational risk arises when a foreign joint venture partner faces asset seizure due to a co-owner’s liabilities. The objection cannot be executed if the rights of the non-party are strictly contractual rather than proprietary. Securing registered title before enforcement action begins remains necessary.
