Stay Request
Filing a formal petition with the China National Intellectual Property Administration requires evidence of a case acceptance notice from a People’s Court. The article 15 ownership dispute effectively freezes the status of the patent application for an initial period of six months. Extensions are granted only upon proof that the litigation is still active.
Administrative Freeze
Suspension of all handling of the application follows the acceptance of the stay request by the authorities. During an article 15 ownership dispute, the patent office will not permit the withdrawal of the application or the change of the applicant name. This protection ensures that the final judicial decision can be executed without the asset being moved out of reach.
Entitlement Judgment
Successful resolution of the case in court provides the basis for lifting the administrative suspension.
