Meaning
A formal written statement submitted by a nominated or appointed arbitrator details any personal, financial, or professional relationships with the parties or their counsel. Under PRC Arbitration Law, this arbitrator conflict disclosure represents a fundamental mechanism to ensure impartiality and prevent judicial challenges to the final award. The document must list any previous employment, advisory roles, or shareholdings in any of the disputing companies.
It also covers close family relationships or shared commercial interests. Failure to provide this information can lead to the annulment of the award.
Disclosure Standard
The China International Economic and Trade Arbitration Commission enforces strict guidelines regarding which connections must be reported. An arbitrator must reveal any relationship that might raise reasonable doubts about their independence. This includes serving as a legal representative for a party within the past three years or holding a position in a parent company of a litigant.
Even indirect ties, such as joint research projects or common membership in professional committees, should be reported. The standard is objective and does not depend on the arbitrator’s own belief in their neutrality.
Recusal Consequence
A party can request the disqualification of the arbitrator if the submitted document reveals a direct connection. The commission’s chairman makes the final decision on whether the conflict requires recusal. If approved, the arbitrator must step down.
This process protects the integrity of the subsequent proceedings.
Challenge Window
The time period for raising an objection is short. A party must submit a written challenge within fifteen days of receiving the arbitrator conflict disclosure. If the conflict is discovered later, the challenge must be filed before the final hearing concludes.
Missing this deadline is generally treated as a waiver of the right to object. This strict limit prevents parties from holding back objections as a tactical move to delay the enforcement of a future adverse award.
