Valuation Method
Formal assessment begins when the court appoints a qualified valuation institution through an automated selection platform. This entity analyzes the physical condition and market demand of the asset to establish a baseline worth. Chinese law requires the valuer to use historical transactional records and current economic indices to justify the calculated amount.
Once submitted, the judicial execution bureau must deliver this valuation report to both the creditor and the debtor to ensure procedural transparency.
Statutory Discount
Chinese enforcement rules set clear boundaries on how far a court may reduce the minimum bid across successive attempts. For real property, the discount in the second auction cannot exceed twenty percent of the initial appraisal reserve price. If a third round becomes necessary, a further twenty percent reduction is permitted.
Personal property permits even steeper reductions to facilitate rapid liquidation of depreciating goods.
Participant Remedy
Interested parties hold specific legal channels to contest the established bidding baseline if they identify formal discrepancies. Creditors or debtors can file a written objection within ten days of receiving the appraisal notification. The executing court holds the authority to order a re-evaluation or dismiss the objection if the valuation follows established protocols.
