By utilizing the advance valuation ruling, a foreign entity reduces the risk of retrospective customs adjustments and valuation disputes at the border.
The binding nature of this decision applies only to the specific importer of record for three years from the date of issue.
Application Process
Filing for this legal status requires the applicant to submit a formal request via the online single window platform at least three months before the planned import date. The local customs office of direct registry handles the initial verification of transaction details and related documents. An applicant must supply sales contracts, pricing agreements, and audited financial statements to justify the declared price.
If the authorities request additional corporate information, the trade representative has fifteen days to submit the supplementary documentation.
Valuation Standard
The assessment of transactions under this regulatory framework relies on the transaction value method or alternate methods defined by the domestic tariff regulations. Trade specialists examine whether a relationship between the buyer and the seller influences the transaction price. Where transfer pricing is involved, the advance valuation ruling aligns with the arm’s length principle to ensure the customs valuation is not distorted.
This review evaluates related party transactions, intellectual property licensing fees, and assist costs that must be added to the price. It excludes post-importation expenses, local distribution costs, and assembly fees. When a ruling is finalized, the customs authority issues a formal written decision that remains valid across all ports of entry in the country.
Enforcement Boundary
The legal effect of the decision ceases if the importer presents inaccurate transaction facts during the filing procedure or if the underlying commercial contracts are amended. The regional customs authorities can invalidate the ruling retrospectively, exposing the importer to penalty actions and duty recalculations. Changes in national legislation or international treaties also nullify the administrative decision.
